1. General Terms and Provisions

1.1. These Terms of Use (’Terms’) apply to all Website visitors (’Visitors’ or ’you’) and Forum users (’Users’ or ’you’) and govern your access to the Website and the Forum. At Bitcoin.se (’Bitcoin.se’, ‘we’, ‘our’ or ‘us’), we are sharing information, news and provide a platform for discussion about Bitcoin, cryptocurrencies, blockchain technology and economics. Furthermore you can also find a relevant Bitcoin seller through our website, which you can find at http://bitcoin.se/ (‘Website’) and our forum at https://forum.bitcoin.se/ (‘Forum’).

1.2. Please read these Terms carefully before using our Website or registering to our Forum.

1.3. By accessing or using our Website you confirm that you have read, understood and accept these Terms and that you agree to comply with them. If you do not agree to these Terms, please do not use or access (or continue to use or access) the Website.

1.4. Present Terms are effective as of their publication and remain effective until revoked. These Terms are continuously available through our Website, at forum.bitcoin.se/tos.

1.5. Unless explicitly agreed in writing, Bitcoin.se does not accept any terms or conditions other than those present in these Terms.

1.6. These Terms may only be concluded electronically via the Website. These Terms shall cover all legal relationships established between the Visitor or User and us and set out the Parties’ rights and obligations.

3. Definitions

a) Account: an account created by the User during registration to the Forum, which contains information about said User and to which User may login to in order to use the Forum.

b) Bitcoin.se: Rational Money AB, that is the sole owner, creator and operator of the Website. Rational Money AB is a subsidiary of Safello Group AB (org. no. 556892-3550).

c) Suspension (of Account): An action that may be performed by us, the result of which is that a User is no longer able to login to his/her Account and use the Forum, until the action is lifted. An Account may be suspended subject to these Terms.

d) Buy Bitcoin Page: The page available at Köpa Bitcoin i Sverige - Swish och andra alternativ where you can get to know and use third party providers to buy Bitcoin or other cryptocurrencies.

e) Cancellation (of Account): An action that may be performed by us, the result of which is that a User is no longer able to login to his/her Account and use the Forum. This action is final, it cannot be lifted. An Account may be cancelled subject to these Terms.

f) Cookies: Small text files that are placed on the Visitor’s computer by websites that the Visitor is visiting. Cookies are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the website. Cookies are typically stored on your computer’s hard drive.

g) Forum: our interactive communication platform which is available as part of the Website at https://forum.bitcoin.se/.

h) Parties: User or Visitor and Bitcoin.se together.

i) Party: User or Visitor or Bitcoin.se.

j) Privacy Policy: our statements on how we handle personal data.

k) Registration: In order to be able to use our Forum, you must create an Account. You can find more details about it in section 7. in these Terms.

l) Safello: Safello is used to refer to the group which Bitcoin.se belongs to, and includes the following companies: Safello Group AB (org. no. 556892-3550), Safello AB (org. no. 556954-4165) and Safello Technology Development AB (org. no. 556984-5265).

m) Sell Bitcoin Page: The page available at https://www.bitcoin.se/salja-bitcoin where you can get to know and use third party providers to sell Bitcoin or other cryptocurrencies.

n) Terms: this Terms of Use which provide a framework for regulating the legal relationships between the Visitor or User and Bitcoin.se as regards the access to the Website and use of the Forum.

o) User: All persons creating an Account and using our Forum.

p) Visitor: All persons visiting the Website without creating an Account.

q) Website(s): the website operated by us, available at http://bitcoin.se/. Unless otherwise indicated, when referring to the Website, the Forum is also included in the definition.

r) Widget: A widget is a piece of software that is used on a page of a website or an application to give the user changing information of a particular type in a small area of the computer screen. Bitcoin.se as an agent of Safello may place the widget created by Safello on the Website where Visitors are able to use Safello’s services.

4. Features of our Website

4.1. Bitcoin.se provides informative content about cryptocurrencies, blockchain technology and economics, such as articles, how-to guides and a collection of frequently asked questions on the most important topics. Our website is targeted mainly to Visitors from Sweden, but the majority of the content is available also in English.

4.2. We also offer a communication platform (’Forum’), where our Users can have discussions about cryptocurrency related topics. Our Forum is available in Swedish.

4.3. Bitcoin.se also functions as an agent to Safello, a cryptocurrency exchange company, via a Widget powered by Safello. By using the Widget, our Visitors with Swedish BankID are able to easily buy Bitcoin on the Buy Bitcoin Page or sell Bitcoin on the Sell Bitcoin Page. By using the Widget to buy or sell Bitcoin, you are entering into a contract directly with Safello, and Safello’s Terms of Service are applicable to these transactions; Bitcoin.se is only acting as an agent, we are not a provider of cryptocurrency exchange services to any extent.

4.4. On our Buy Bitcoin Page and Sell Bitcoin Page, you can also find other options and exchanges where you are able to buy or sell Bitcoin and other cryptocurrencies. We provide you with a short description on the different providers in order to help you choose the one that best fits your needs. By clicking on the hyperlink of each provider, you will be redirected to other websites where other terms and conditions may be applicable. Bitcoin.se itself does not provide cryptocurrency exchange services to any extent. Depending on which language version of the Website you are using, and on your jurisdiction, we may show you different options and the Buy Bitcoin Page and Sell Bitcoin Page may appear differently. It is always your responsibility however, to make sure you comply with the rules and regulations applicable to your conduct.

4.5. Bitcoin.se does not provide investment or advisory advice and will have no liability for the use or interpretation of information published on our Website, including the Forum. You, as our Visitor, must understand that there are risks involved in investing and trading with cryptocurrencies. We encourage all of our Visitors to exercise prudence and to trade responsibly.

5. Website Content

5.1. We may update our Website and may change the content on the Website at any time.

5.2. The Website is available in Swedish and in English. Certain content may differ on the different language versions and we do not guarantee that all Website content available on the Swedish version is also available on the English and vice versa. The Forum, although it is part of the Website, is only available in Swedish.

5.3. All content on the Website is provided for general information only. We always do our best to update the content on the Website, we make no representations, warranties or guarantees, whether express or implied, that such content is accurate, complete, up-to-date or free from errors or omissions. We do not guarantee that the Website will be secure or free from bugs or viruses.

5.4. Any information posted on our Website and on our Forum shall not be considered as financial advice. You are solely responsible for any harm, damage, loss of your financial decision.

5.5. We are entitled to discontinue the Website, including the Forum in its entirety or partially, at any time without prior notice.

6. Eligibility, use of the Website by minors

6.1. Our Website is aimed mainly towards Swedish audiences. It is your own responsibility as our Visitor to make sure you comply with your local laws and regulations. People who are prohibited from having access to the information on this Website, or those who are in doubt whether or not they are permitted to access the Website or not, are kindly requested to leave the Website.

6.2. The use and access of the Website by minors is subject to consent of their parent or guardian. It is their responsibility to determine whether any of the content is appropriate for their children. In any case, we advise parents who permit their children to access and use our Website that it is extremely important that they communicate with their children about online safety. 7. Forum registration

7.1. In order to be able to use our Forum, you must create an Account with Bitcoin.se. Only then, you may interact with other Users on the Forum interface. Without a registration, you will be able to read the contents of the Forum, but you will not be able to join the discussions, like posts, or use any of the interactive options of the Forum.

7.2. For the registration, you must provide us your email address, choose an available username and a password, and you will need to verify your email address as well. Optionally you may provide us your name as well, in which case it will be publicly visible in your user profile.

7.3. By accepting these Terms, you represent that any and all information you provide us is true and accurate, and you agree to promptly update any information you provide to us so that such information is complete and accurate at all times. Any false or fraudulent information and/or use of the Forum rendered to you is prohibited.

7.4. You are responsible for maintaining the confidentiality of your passwords, email address or other account identifiers and all activities that occur under your Account.

7.5. By registering on the Forum, you also agree and represent that:

1. your Account and password are personal to you and may not be used by anyone else to access the Forum;
2. you do not have an existing Bitcoin.se Account;
3. you are not creating Accounts for the purpose of abusing the functionality of the Forum, or other Users; nor will you seek to pass yourself off as another User;
4. are an individual, legal person or other organization with full legal capacity and authority to enter into these Terms;
5. have not been suspended or banned from using our Forum.

7.6. You agree to notify us immediately if you become aware of any unauthorised use of any breach of security or unauthorized use of your Account or password.

7.7. By accepting these Terms as our User, you also consent to receive electronic communication from Bitcoin.se. Such communication may include for example information about your account and other communication between you, our User and us, notices, changes to our Terms or other information relevant to our relationship.

8. Permitted use

8.1. Accounts can only be used by the person whose email address or name they are registered under. Bitcoin.se reserves the right to Suspend or Cancel Accounts that are used by persons other than the persons whose email addresses or names they are registered under, or Accounts that are used by more than one person.

8.2. By accepting these Terms and accessing our Website or Forum, you agree and warrant that you will use our Website and Forum in a lawful manner (i.e. you won’t post any unlawful, defamatory, abusive, hateful, harassing, threatening, spam and/or insulting question, comments and remarks) and in good faith.

8.3. Your use of our Website and Forum shall not violate public interests, public ethics or others’ legitimate interests, including but not limited to taking any action that would interfere with, disrupt, negatively affect or prohibit other Users from using the Forum or other Visitors to access the Website. You are personally responsible for any activity on our platforms, especially on our Forum.

8.4. You warrant that all content submitted or posted by you to the Forum does not violate the rights of any third party, including, but not limited to, infringing intellectual property rights.

8.5. Every content you upload may be reviewed by Bitcoin.se. We reserve the right to remove or modify any content, including but not limited to text, comment or photo, for any reason and without explanation, especially if, according to our judgment, the content does not comply with these Terms, the applicable laws or regulations, is offensive, illegal or might violate the rights, harm, or threaten the safety of others.

8.6. You are solely responsible for any content that you publish or display or in any other way make available on or through the Forum. Content on the Forum is not automatically reviewed by Bitcoin.se before posted and does not reflect our opinions and policies. We are not responsible for, and do not guarantee the accuracy, reliability, integrity or quality of any content published on the Forum by Users. Bitcoin.se is explicitly not responsible for and does not endorse any content created by Users on the Forum.

8.7. Below you will find a non-exhaustive list of the kind of content and behavior that is prohibited on the Forum. Please note that this is not a complete list, but it should be used as a guideline to the spirit of what is prohibited use. Bitcoin.se reserves the right to inspect content and User behaviour and take appropriate legal action against anyone who infringes these provisions, including, but not limited to, removing the offending content, Suspending or Cancelling the Account of the offending User and, if necessary, reporting to the relevant law enforcement authorities. Therefore, you are especially not allowed to post content or use the Forum in any way that:

• is offensive and/or promotes racism, prejudice, hatred or physical harm against any individual or group;
• is harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
• displays pornographic, sexually explicit or violent material of any kind;
• harms or attempts to harm minors in any way;
• impersonates any person or entity, including, but not limited to, a Bitcoin.se admin, or falsely states or otherwise misrepresents your affiliation with a person or entity;
• exploits people in a sexual or violent manner;
• contains political or religious propaganda;
• qualifies as criminal activity such as drug dealing, trafficking, child pornography, fraud, stalking, spamming, sending of harmful computer files, theft of trade secrets or intrusion of copyright or patent rights;
• discloses any personal data or personal information of any kind, of any private individual, especially without the consent of that person;
• uses any information from the Forum in order to stalk, harass, abuse or harm another person;
• promotes information that you know is deceptive or promotes illegal activities or provides instructions about illegal activities;
• involves commercial activities such as advertising or sales of services or products without our prior consent;
• is interfering with, disrupting or creating an undue burden on the Website or Forum;
• contains viruses, trojans, worms or any other computer code, programs or files designed to destroy, interrupt or limit the functionality of any computer, computer software or hardware or telecommunications equipment.

8.8. Please note that in case you include hyper-links to other sites, you may be seen as endorsing the material and content on such sites. It is advisable to you to warn people accessing these linked sites that you do not endorse or take responsibility for material present on these sites.

8.9. As our User, you have the right to, and we encourage you to flag and report to moderators any User content on the Forum that is against these Terms. Our moderators will review the content and take the appropriate action, which may include, among others, deleting the content, suspending the User, cancelling the Account and/or reporting to the relevant authorities, if necessary.

9. User content

9.1. Any content you upload or post on the Forum will be considered non-confidential and non-proprietary. You retain all of your ownership rights in such content, but by posting it, you grant Bitcoin.se a royalty-free, non-exclusive, perpetual, irrevocable, assignable, unrestricted, world-wide license to use, modify, copy, translate, adapt, publicly display, publicly perform, transmit, reproduce, store and distribute such content.

9.2. You warrant and represent that you own the contents posted by you or otherwise have the right to grant the above described license. You agree to pay for all fees, royalties and any other duty owed to any person or company by reason of any contents posted by you to the Forum.

10. Liability

10.1. The Website and the Forum are provided on an „as is’’ and „as available” basis. Use of the Website and the Forum, and any information or content obtained from the Website is at your own risk and Bitcoin.se hereby expressly disclaims, to the fullest extent permitted by applicable laws and regulations, all warranties and liabilities of any kind whatsoever in relation to such content. We especially provide no warranty as to the availability or accuracy of the Website or its content and content posted on the Forum by our Users.

10.2. Bitcoin.se does not have any responsibility for content that is presented on it’s Website which directly or indirectly damages or creates a loss for our User or any other person who is affected. Bitcoin.se specifically claims no responsibility for direct or indirect damages, loss of profit or income, or any other damage towards the User or a third party that might occur due to inconsistent, false or non-existent information presented on the Website.

10.3. We keep improving and upgrading our Website, which may result in occasional server outages. We may perform maintenance or changes to the Website at any time we see fit, however, we aim to schedule maintenance when our servers are less busy. This still could result in periods during which the Website is temporarily unavailable. We will, to the extent that it is possible, announce such interruptions in advance. However, we are not required to do so. We are doing our best to provide constant, uninterrupted access to the Website, however, we cannot guarantee this, and we are not responsible for any damages or losses resulting from server outages, interruption or delay.

11. Indemnity

You agree to protect, defend, indemnify and hold harmless Bitcoin.se, our officers, directors, employees, agents and third party service providers from and against any and all claims, demands, costs, expenses, losses, liabilities and damages of every kind and nature (including, without limitation, reasonable attorneys’ fees) imposed upon or incurred by us directly or indirectly arising from

1. your use of and access to our Website or Forum;
2. your violation of any provision of these Terms;
3. your violation of any third-party right.

12. Third party links

Where Bitcoin.se provides text links to third party websites, such links are not an endorsement by Bitcoin.se of any products or services provided on or via such websites. The use of such links is entirely at the Visitor’s own risk and Bitcoin.se shall not be held responsible or liable for the content, use or availability of such websites. We are not obliged to verify the truth, accuracy, reasonability, reliability, relevance or completeness of any content of such websites. You, as our Visitor will need to make your own independent judgement regarding your interaction with these websites.

13. No financial or legal advice

13.1. Bitcoin.se is not your broker, intermediary, agent, or advisor and we have no fiduciary relationship or obligation to you in connection with any investments, transactions or any other decisions or activities that you carry out based on any information on our Website, including our Forum. We do not offer advice but are more than happy to share information. No communication or information provided to you by Bitcoin.se should be understood as investment advice, financial advice, trading advice, or any other sort of advice.

13.2. We will not be responsible for the decisions you make to buy, sell, or hold cryptocurrency based on the information provided by Bitcoin.se. Before you make the decision to buy, sell or hold any cryptocurrencies, please consult your own legal or tax professional regarding your specific situation.

14. Change of these Terms

14.1. Bitcoin.se reserves the right to unilaterally modify and update these Terms and its Privacy Policy.

14.2. For further use of the Website or the Forum, after any modification, you shall accept the new Terms. You have the right to opt out from the new Terms, by closing your Account by the date these changes come into effect.

15. Cookies

15.1. Our Website is using cookies. To achieve the best user experience you shall accept these. However, you have the right to change the cookie settings of your browser and block Cookies. You also have to be aware that blocking Cookies may have a negative effect on the website’s functions and it may not work as intended.

16. Term and Termination by the User

16.1. These Terms as an agreement between the Parties shall remain in effect until terminated.

16.2. You may terminate your Account at any time, even though we would be sad to see you go. If you no longer wish to be a registered User of the Forum, you can terminate your Account by written termination to admin@bitcoin.se. We would appreciate it if you provided us with information on the reasons for this termination so that we have the opportunity to improve.

16.3. You understand that your Account will be cancelled upon effective termination of these Terms, and you will not be able to access it further on.

16.4. You understand that termination of your Account does not also mean erasure of your personal data by Bitcoin.se, as we are legally obligated to retain such data in most cases. Please see our Privacy Policy for more details on how we handle your data.

16.5. If you no longer accept these Terms, or any future modification to these terms and conditions, you must cease using the Website. Continued use of the Website indicates your continued acceptance of these Terms.

17. Breach of Terms and Termination by us

17.1. We may choose to Cancel your Account immediately, at our sole discretion if you violate these Terms. In such cases, we reserve the right to cancel your Account and terminate your access or use of the Forum and, if relevant, the Website without prior notice.

17.2. The Suspending of an Account of any User can be lifted if the reasons for such action are no longer present. Following such action, you will regain full control of your Account but Bitcoin.se has the right to suspend your Account again if necessary according to these Terms.

18. Intellectual Property Rights

18.1. Bitcoin.se, in all circumstances, retains intellectual property rights (including but not limited to copyright, trademarks, trade names etc.) of the Website and of all content on it. You may not copy, modify, reproduce, republish, post, transmit or distribute in any way any material from this Website including the underlying code and software, unless Bitcoin.se has given prior written permission for such action.

18.2. You are authorised to use the Website and its contents for your personal, non–commercial use only. This amounts to viewing the Website and printing off individual pages or sections for personal use. Except as expressly authorised by Bitcoin.se, you are not allowed to create a database in electronic or paper form comprising all or part of the material on the Website.

18.3. By accepting these Terms, you agree to respect the rights of Bitcoin.se and agree to use the aforementioned contents according to the applicable law. These contents and their source shall be quoted and indicated according to the applicable copyright legislation.

18.4. The trademarks or logos included on the Website shall not be reproduced, published or distributed or used in any manner without the previous written consent of Bitcoin.se. Rights of third parties related to their publications, trademarks and other intellectual properties shall also be handled as Bitcoin.se’s unless otherwise permitted in writing by their respective owners.

20. Governing Law and Dispute Resolution

The Swedish law is applicable to these Terms, to our Website and the Forum. By accepting these Terms you accept that all disputes shall be settled primarily in a peaceful way. You shall contact us at admin@bitcoin.se before initiating legal proceedings. For any disputes, claims or controversies arising out of any use of our Website and Forum, the courts of Sweden shall have exclusive jurisdiction, unless expressly stated otherwise by applicable laws or regulation of binding nature.

21. Miscellaneous

21.1. Severability. If a competent court deems any term or provision of these Terms null and void, other provisions of these Terms will not be affected by it and the validity and enforceability of any remaining part, term or provision stays effective.

21.2. Entire Agreement. These Terms constitute the entire agreement between you and Bitcoin.se. Other regular practice or methods of dealing between the parties will not be used to modify, interpret, supplement, or alter these Terms.

21.3. Waiver. Our failure or delay in exercising any right, power or privilege under these Terms shall not be interpreted as a waiver thereof.

21.4. Language. These Terms are provided in English. Any other communication between the Parties shall be in English or in Swedish.

21.5. Force Majeure. Bitcoin.se is not accountable for any kind of damage you may experience from events beyond our control. These events include but are not limited to explosion, fire, flooding or other accidents, epidemic, pandemic, sabotage, event of warfare, strike or other work-related conflict, changes of laws or regulations, or other decisions made by regulatory bodies. The conditions about strike or other work-related conflict also apply in cases where Bitcoin.se takes action or is a target for such a conflict.

21.6. Assignment. Agreements between the Parties are solely for the benefit of the parties and may not be transferred to another party. Visitors and Users cannot assign or transfer any rights or obligations under these Terms.

21.7. Headings. Headings of sections are for convenience only and shall not be used to limit or construe such sections.
